SO TONIGHT, WE ARE FORTUNATE TO HAVE WITH US BRITTANY COX, WHO IS OUR LEADER OF OUR DIVERSITY ADVISORY COUNCIL.

AND I THOUGHT IT WOULD BE A GREAT USE OF OUR TIME TO SEE THE HIGHLIGHTS FROM THE PAST COUPLE OF YEARS, BECAUSE I HAVEN'T HAD AN OPPORTUNITY TO FEATURE THAT PARTICULAR GROUP. IF YOU'LL REMEMBER, I STARTED THIS SEVERAL YEARS AGO FOR REPRESENTATIVES FROM EACH CAMPUS TO ADVISE ME.

AS FAR AS OUR SYSTEMS. WE WANT TO MAKE SURE THAT OPPORTUNITIES ARE THERE FOR EVERY SINGLE KID AND THAT WE DON'T HAVE ANY PARTICULAR BARRIERS TO THEIR LEARNING.

AND SO WE STARTED THIS COUNCIL.

AND SO, BRITTANY, IF YOU'LL COME FORWARD, SHE IS GOING TO SHARE WITH YOU THE HIGHLIGHTS THAT WE'VE BEEN WORKING ON.

AND THEN YOU GUYS CAN ASK US AND [INAUDIBLE].

SO, BRITTANY, WELCOME.

HI. THANK YOU.

SO MY NAME IS BRITTANY. I'M CURRENTLY A THIRD GRADE TEACHER AT BUDA ELEMENTARY, BUT I'VE WORKED AT VARIOUS CAMPUSES AS WELL AS GREW UP IN THE DISTRICT.

SO IT'S AN HONOR TO BE HERE.

SOME OF THE HIGHLIGHTS THAT WE'VE HAD IS REALLY OUR STUDENT DIVERSITY COUNCIL.

WE HAVE ONE REPRESENTATIVE FROM EACH MIDDLE SCHOOL AS WELL AS TWO REPRESENTATIVES FROM EACH HIGH SCHOOL FRESHMAN THROUGH SOPHOMORE REPRESENTATIVE IN THE JUNIOR THROUGH SENIOR. AND THEY REALLY HAVE BEEN ABLE TO GIVE US REAL FEEDBACK ON CURRICULUM AND INSTRUCTION THAT THEY'RE SEEING DAILY IN THEIR SCHOOLS AND THE ADVANCED COURSES, IN PARTICULAR, THE NEED FOR ACADEMIC SUPPORT AND THE BRIDGES TO GET STUDENTS INTO THOSE ADVANCED CLASSES.

WE'VE REALLY HAD MORE OF AN OPT OUT APPROACH TO THE ADVANCED COURSES, WHICH THEY REALLY HAVE HAD REALLY AWESOME FEEDBACK ABOUT.

ALSO, WE'VE BEEN ABLE TO HELP THEM IMPLEMENT INNOVATIVE TUTORING MODELS, COMMUNICATION WITH SPECIALIZED PROGRAMS ACROSS THE DISTRICT, AND THE NEED FOR MAKING THESE COURSES MORE ACCESSIBLE FOR ALL STUDENTS, WHETHER THAT BE SOMETHING FROM TRANSPORTATION OR JUST GETTING THE WORD OUT THERE THAT THESE PROGRAMS EXIST IN OUR DISTRICT.

STUDENTS HAVE ALSO SHARED A REAL NEED FOR THEIR MENTAL HEALTH AND THE STRUGGLES THAT THEY'RE GOING THROUGH FROM VARIOUS BACKGROUNDS, INFORMATION NEEDING MENTAL HEALTH DAYS FOR THEM AND FOR TEACHERS.

THEY SEE A NEED FOR MORE PLANNING TIME FOR THEIR TEACHERS, AND THEY'RE REALLY MINDFUL OF THE STRESS AND THE BURNOUT THAT THEIR TEACHERS ARE FEELING.

AND SO THIS WORK HAS REALLY HELPED THE DISTRICT LEAD TO BEING REALLY STRATEGIC IN OUR PLC DAYS AND THE PLANNING THAT THAT HAS COME FROM.

WE ALSO HAVE HAD A LOT OF SUCCESS WITH OUR PROFESSIONAL DEVELOPMENT.

THE DISTRICT HAS PARTNERED WITH NAPE AND THE DIVERSITY COUNCIL GOT THE OPPORTUNITY TO ATTEND THEIR MICRO MESSAGING VIA ZOOM.

AND SO THEN WE BROUGHT THAT TO THE DISTRICT AS WELL.

AND WE'VE HAD A LOT OF GREAT SUCCESS AND GREAT FEEDBACK WITH THAT.

AND KIND OF MOVING FORWARD, WHAT IS THAT GOING TO LOOK LIKE NOW THAT WE'RE KIND OF OUT OF THE PANDEMIC, OUT OF DOING THINGS ON ZOOM? YOU KNOW, HOW CAN WE CONTINUE THIS CONVERSATION AND REALLY USE THAT AS A LAUNCHING PAD TO CONTINUE THAT WORK WITH MORE IN-DEPTH CONVERSATIONS IN PERSON? WE'VE ALSO BEEN ABLE TO ADD ONLINE PLATFORMS TO OUR SAFE SCHOOLS AND REALLY HAVE TEACHERS CONTINUE THAT WORK YEARLY THROUGH THE SAFE SCHOOLS TRAINING.

AND THEN CURRENTLY WE'RE WORKING ON PUTTING TOGETHER REALLY MICRO PDS THAT THE STAFF DIVERSITY COUNCIL CAN TAKE BACK TO THEIR CAMPUSES AND FIVE TEN MINUTE CONVERSATIONS, YOU KNOW, ONCE A MONTH OR EVEN QUARTERLY THAT WE CAN REALLY IMPLEMENT IN THE SCHOOLS THAT WE'RE WORKING IN.

THIS REALLY HAS LED TO OPENING DIALOG FOR POSITIVE RELATIONSHIPS WITH OUR COWORKERS, BUT ALSO WITH OUR STUDENTS FROM VARIOUS BACKGROUNDS AND REALLY HELPING, YOU KNOW, JUST BUILD THAT COMMUNITY WITHIN OUR CAMPUSES, BUT THEN ALSO WITHIN OUR DISTRICT.

WE ALSO HAVE IMPLEMENTED A LIBRARY SEARCH FEATURE THROUGH THE DESTINY PROGRAM THAT WE USE.

IT HAS BEEN TURNED ON.

AND SO STUDENTS ARE ABLE TO STUDENTS OR TEACHERS ARE ABLE TO LOOK UP BOOKS BASED OFF OF CHARACTERS OR BOOKS BASED OFF OF CERTAIN EXPERIENCES THAT OUR STUDENTS HAVE HAD AND REALLY PINPOINT BOOKS THAT ARE AVAILABLE IN OUR DISTRICT FOR THEM.

AND SO MOVING FORWARD, WE'RE LOOKING AT OUR LIBRARIANS TRAINED ON THIS.

DO LANGUAGE ARTS TEACHERS KNOW THAT IT EXISTS? AND KIND OF WHAT HOW MANY PEOPLE ARE USING IT, THINGS LIKE THAT.

WE HAVE ALSO STARTED LOOKING AT OUR ESL AND BILINGUAL IDENTIFICATION PROCESS AND WHAT THAT LOOKS LIKE SPECIFICALLY FOR OUR ESL AND BILINGUAL STUDENTS.

THE ELEMENTARY. LIT WORLD LANGUAGE ESL LIBRARY AT SUNFIELD ELEMENTARY, SOMETHING THAT WE'RE LOOKING FOR THIS YEAR, REALLY BEING ABLE TO BRIDGE A WIDE VARIETY OF LANGUAGES. OUR DISTRICT DOES A REALLY GOOD JOB OF SUPPORTING OUR SPANISH SPEAKING STUDENTS, AND SO HOW CAN WE MAKE SURE THAT THE OTHER WIDE VARIETY OF LANGUAGES THAT WE HAVE ARE GETTING THE EQUAL AMOUNT OF SUPPORT AND WAYS TO HELP THE NEW ELEMENTARY STUDENTS THAT ARE NEW TO COUNTRY REALLY GET A GOOD GRASP OF THE ENGLISH PHONICS SO THAT WHEN THEY MOVE TO MIDDLE SCHOOL AND HIGH SCHOOL, THEY'RE NOT STILL STRUGGLING WITH ACQUIRING THAT LANGUAGE.

THEY HAVE THAT SUPPORT REALLY EARLY ON WHEN THEY'RE STARTING.

ANOTHER HIGHLIGHT HAS BEEN THE ONE COMMUNITY, ONE BOOK EVENT IF YOU WERE ABLE TO JOIN.

IT WAS A REALLY AWESOME EVENT THAT WAS A PART OF THE DISTRICT, BUT ALSO THE COMMUNITY AS A WHOLE.

THE PURPOSE WAS TO ENGAGE IN CONVERSATION ABOUT THE BOOK WITH THE HOPE TO GATHER THE COMMUNITY MEMBERS AND EFFORTS TO EMPHASIZE THE IMPORTANCE OF TOGETHERNESS AND COMMUNITY WHILE PROMOTING LITERACY AND DIALOG.

THE BOOK THAT THEY CHOSE WAS SEED FOLKS, AND WE HAD A TON OF PEOPLE IN PERSON, BUT WE ALSO HAD THOUSANDS OF VIEWS ON OUR YOUTUBE THAT THE CITY OF KYLE LIVE STREAMED FOR US. SO THAT WAS A REALLY NICE EVENT.

WE HAD A NUMBER OF PANELISTS COME IN AND IT WAS JUST A REALLY GREAT DISCUSSION FOR THIS YEAR.

WE WOULD LIKE TO TRY AND FIND A BOOK THAT'S YOUNG ADULT THAT ALSO HAS A YOUTH EDITION SO THAT WE CAN INCLUDE OUR ELEMENTARY FAMILIES AND ELEMENTARY STUDENTS AS WELL. WE ALSO HAVE RELAUNCHED THE PEER COUNSELING PROGRAM.

THIS STARTED THROUGH THE MATH PATHWAYS, WHICH OUR DISTRICT HAS PARTNERED WITH AND THE DAC.

WHENEVER I WAS IN HIGH SCHOOL, WE HAD A MENTOR PROGRAM AND FOR VARIOUS REASONS WE JUST WEREN'T HAVING THAT ANYMORE.

AND SO WE WERE ABLE TO RELAUNCH THAT AND HAVE HIGH SCHOOL STUDENTS, VOLUNTEER OR COMMUNITY MEMBERS VOLUNTEER TO MENTOR OUR ELEMENTARY STUDENTS.

MOVING FORWARD, I WOULD LIKE TO BE REALLY STRATEGIC IN THE COUNCIL, WOULD LIKE TO BE REALLY STRATEGIC IN THE WAY THAT WE PARTNER STUDENTS, WHETHER THAT BE STUDENTS THAT SHARE A COMMON LANGUAGE, WHETHER THAT BE THEY SHARE A COMMON HOME LIFE SITUATION.

MAYBE THE ELEMENTARY STUDENT IS GOING THROUGH A DIVORCE AND OR HIS PARENTS ARE, AND THE HIGH SCHOOL STUDENT WENT THROUGH THAT.

SO PARTNERING THEM TOGETHER SO THAT THE ELEMENTARY STUDENTS CAN REALLY SEE THEMSELVES IN THOSE ADVANCED CLASSES, CAN SEE THEMSELVES, YOU KNOW, AT THAT NEXT STEP, BECAUSE IN ELEMENTARY, THEIR VIEWS ARE SO LIMITED AND SO REALLY MAKING SURE THAT WE'RE PARTNERING THEM STRATEGICALLY IS OUR NEXT STEP WITH THAT.

AND THEN WE ALSO HAVE HIRED A CONSULTANT, WHICH OUR DISTRICT HAS BEEN WORKING WITH CLOSELY.

THIS IS THE FIRST TIME THE CONSULTANT WORKED WITH A SCHOOL DISTRICT.

AND SO THAT WAS NEW FOR THEM AND NEW FOR US.

BUT THERE WAS A LOT OF GREAT FINDINGS AND I KNOW DR.

WRIGHT IS GOING TO SPEAK ABOUT, BUT REALLY THE THE OVERALL CONSENSUS WAS THAT OUR TEACHERS ARE WANTING MORE TRAINING ON THESE TYPES OF THINGS.

THEY'RE WANTING TO BE MORE TRAUMA INFORMED.

THEY'RE WANTING. THEY JUST DON'T KNOW WHERE TO START.

AND SO THAT WAS THE BIGGEST FINDING FOR US, THAT THE BIGGEST TAKEAWAY.

AND SO REALLY MOVING FORWARD, WE HAVE, LIKE I SAID, WE HAVE SOME GREAT THINGS PLANNED.

WE HAVE SOME THINGS THAT WE'VE STARTED THAT WE'RE JUST CONTINUING IN THE PROCESS OF REVAMPING AND RETOUCHING AND REFINING.

BUT OVERALL, I'M VERY PROUD OF THE WORK THAT WE'VE DONE.

AND THAT'S SOMETHING THAT SPEAKS TO MY HEART.

BUT OF ALL THE THINGS THAT THAT SHE MENTIONED, I'M GOING TO MENTION AND JUST REEMPHASIZE A COUPLE OF THINGS.

SO WE KNOW THAT BY WORKING WITH E3 ALLIANCE THAT THE MORE MATH KIDS HAVE IN THEIR CAREER WILL EQUATE TO MORE MONEY IN THEIR SALARIES DOWN THE ROAD, WHICH IS A HUGE RETURN ON THEIR ON THE INVESTMENT.

SO FROM THIS GROUP, WE REALLY TALKED ABOUT IT AND DEREK MCDANIEL AND AND I EVEN WENT AND SPOKE AND WE GOT THE LAW CHANGED.

AND SO THAT WAS AN INITIATIVE THAT STARTED WITH OUR DAC TEAM AND AND SO HUGE.

SO NOT ONLY, YOU KNOW, IT'S KIND OF LIKE THE COMMERCIAL.

WHAT STARTS HERE CHANGES THE WORLD.

THAT'S OUR HOPE IS THAT NOW KIDS WON'T KIDS THAT DO WELL AND HAVE THE OPPORTUNITY CAN BE ENCOURAGED BY A TEACHER AND THEY'LL GO IN THESE ADVANCED PATHWAYS AND BE ABLE TO JUST SOAR AND FOR THOSE THAT WANT TO DO IT BUT HAVEN'T SHOWN THE PROFICIENCY YET WE HAVE THE BRIDGES THE BRIDGE CAMPS IN THE SUMMER.

SO WE'RE TRYING TO MAKE IT AVAILABLE TO EVERYONE SO EVERYONE WILL HAVE THE OPPORTUNITY.

BUT THEN THE OTHER PIECE, WHEN WE DO OUR CALENDAR CREATION AND I KNOW DLT IS OUR CALENDAR CREATION COMMITTEE, WE ALSO HAVE MEMBERS FROM THE DAC SPEAK AND FROM THE STUDENTS THAT ADVISE THAT, YOU KNOW, IN SEVERAL OF THE MONTHS THROUGHOUT THE YEAR WHEN THINGS GET REALLY BUSY, WE NEED A MENTAL HEALTH DAY, JUST LIKE THE TEACHERS NEED ONE, THE KIDS NEED ONE.

AND SO A LOT OF THE THINGS THAT WE'VE BEEN DISCUSSING REALLY COME FROM THE FEEDBACK THAT WE'VE LEARNED.

AND THEN SHE MENTIONED ALL THE DIFFERENT LANGUAGES THAT ARE BEING SPOKEN WITHIN HAYS CISD I THINK THE LAST COUNT AND MAY GO UP NOW, BUT I WAS TOLD THAT WE HAVE LIKE 39 DIFFERENT LANGUAGES ACROSS THE DISTRICT NOW.

AND I KNOW HILLARY AT SUNFIELD HAS 24 DIFFERENT LANGUAGES SPOKEN AT SUNFIELD ELEMENTARY.

AND SO WHEN YOU TALK ABOUT MATCHING A PEER THAT SPEAKS THE SAME LANGUAGE IN HIGH SCHOOL OR MIDDLE SCHOOL WITH A CHILD IN ELEMENTARY THAT DOESN'T HAVE THAT CONNECTION, IT GOES A LONG WAY AND IF THEY SEE THAT THEIR COUNTERPARTS IN SECONDARY SCHOOL CAN BE SUCCESSFUL, THEN THEY CAN BE AS WELL.

AND THEN THEY'LL ALWAYS HAVE SOMEONE THAT THEY CAN LEAN ON.

AND THEN THE LAST THING I WANTED TO SHARE IS WE ASKED A CONSULTING FIRM TO COME IN AND SURVEY ALL OF OUR TEACHERS, AND I SHARED THAT INFORMATION WITH YOU ON OUR BOARD BLOG.

AND AND SO HOPEFULLY YOU'VE HAD A CHANCE TO REVIEW THAT.

THERE WERE SOME VERY HIGH MARKS THAT WE THAT WE WERE ABLE TO SCORE.

BUT WE HAVE SOME WORK THAT STILL NEEDS TO BE DONE AS WELL.

AND SO WE PLAN ON REVIEWING ALL THOSE RECOMMENDATIONS AND THEN MOVING FORWARD WITH MANY OF THEM.

AND SO I JUST KIND OF WANTED TO HIGHLIGHT SOME OF THOSE THINGS.

HOW OFTEN DOES THE DIVERSITY ADVISORY COUNCIL MEET? WE MEET ROUGHLY ONCE A MONTH IN THE SPRING TIME.

WE DON'T MEET IN MAY JUST BECAUSE OF TESTING AND HOW CRAZY TEACHER SCHEDULES ARE, BUT IT'S ROUGHLY ONCE A MONTH.

OKAY. AND I LOVE THAT YOU'RE ADDRESSING THE OPPORTUNITY GAPS.

I MEAN, THAT'S DEFINITELY SOMEWHERE THAT WE NEED TO TARGET IS THE OPPORTUNITY GAPS THAT OUR STUDENTS MIGHT HAVE AND CREATING OPPORTUNITY FOR THEM AND PARTNERING. I LOVE THE MENTORING AND PARTNERING WITH THOSE SAME MODELS, RIGHT? HAVING A MENTOR THAT THEY CAN IDENTIFY WITH, BUT ALSO HAVING MENTORS THAT ARE THE OTHER, RIGHT? IT'S SO IMPORTANT TO HAVE THAT EXPOSURE AS WELL BECAUSE THAT MIGHT BE THE ONLY TIME THEY WILL HAVE THAT EXPOSURE.

SO I LOVE HAVING THE OPPORTUNITY TO DO THAT.

WHY ARE THEY NOT AT BOTH? AND AND WE KNOW THAT AS ADULTS THAT BUDGET AND THINGS LIKE THAT ARE A CONCERN, BUT THAT SOME OF THE THINGS THAT THE STUDENTS ARE MORE ASKING FOR ALSO LIKE DR.

WRIGHT SAID, THE BRIDGES PROGRAMS AND MAKING SURE THAT STUDENTS THAT MAYBE ARE NOT QUITE ACADEMICALLY READY FOR SOME OF THOSE PROGRAMS, THAT THEY ARE AWARE THAT THE BRIDGES EXIST OR THAT THEY HAVE THE SUPPORT IN ORDER TO BE READY FOR THOSE THINGS.

I THINK THAT'S AN OBSTACLE THAT WE'RE STILL FACING IS REALLY JUST GETTING THE WORD OUT THERE THAT THESE PROGRAMS EXIST AND THAT THERE'S SUPPORT TO GET YOU INTO THE PROGRAMS. OKAY. SO IT'S SAFE TO SAY THAT WHEN THE ACCESSIBILITY CONCERNS, IT'S MOSTLY ABOUT TRANSPORTATION, NOT ANY OTHER FOR US TO MEET SOMEBODY.

YES. SO THE TITLE FOR THIS AGENDA ITEM IS THE CONSIDERATION AND POSSIBLE ADOPTION OF A RESOLUTION TO JOINT LITIGATION REGARDING THE A TO F ACCOUNTABILITY SYSTEM.

SO THIS IS THE RESOLUTION OF THE BOARD OF TRUSTEES OF THE HAYS CONSOLIDATED INDEPENDENT DISTRICT REGARDING THE A TO F ACCOUNTABILITY SYSTEM, WHEREAS THE A TO F ACCOUNTABILITY SYSTEM IS A STATEWIDE RATING SYSTEM ESTABLISHED BY THE TEXAS LEGISLATURE TO PROVIDE INFORMATION ABOUT THE ACADEMIC PERFORMANCE OF TEXAS SCHOOLS. AND. WHEREAS, THE TEXAS LEGISLATURE AND TEXAS EDUCATION CODE 39.054 HAS GRANTED BROAD AUTHORITY TO THE COMMISSIONER OF THE TEXAS EDUCATION AGENCY TO ADOPT RULES TO EVALUATE SCHOOL DISTRICT AND CAMPUS PERFORMANCE AND ASSIGN EACH DISTRICT AND CAMPUS AN OVERALL PERFORMANCE RATING OF A, B, C, D, OR F, AND.

WHEREAS, THE CURRENT A TO F ACCOUNTABILITY SYSTEM WAS DESIGNED BY THE CURRENT COMMISSIONER.

AND. WHEREAS, DESPITE THE LACK OF A REQUIREMENT IN THE STATUTE THAT THE COMMISSIONER CHANGED THE ACCOUNTABILITY SYSTEM ON ANY PARTICULAR SCHEDULE, THE COMMISSIONER HAS STATED THAT THE A TO F ACCOUNTABILITY SYSTEM SHOULD BE REVISED EVERY FIVE YEARS.

AND. WHEREAS, THE COMMISSIONER INTENDS TO IMPOSE ON A RETROACTIVE BASIS A NEW ACCOUNTABILITY SYSTEM FOR THE 2022-23 SCHOOL YEAR, WHICH HAS STILL YET TO BE FINALIZED.

AND. WHEREAS, THE CHANGES MADE BY THE COMMISSIONER ARE INTENDED TO BE APPLIED TO GRADUATING CLASSES WHO HAVE ALREADY GRADUATED FROM THE HAYS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT.

AND. WHEREAS, THE COMMISSIONER INTENDS TO RELEASE RATINGS FOR THE 22-23 SCHOOL YEAR IN OCTOBER OR NOVEMBER, USING RETROACTIVE UPDATES TO THE ACCOUNTABILITY SYSTEM THAT WOULD LOWER THE RATING OF THOUSANDS OF SCHOOLS.

AND. WHEREAS, THE COMMISSIONER STILL HAS NOT FINALIZED THE RULES AND METHODOLOGIES THAT WILL BE USED TO EVALUATE SCHOOLS FOR THE 2022, 2023 SCHOOL YEAR OR THE 2023, 2024 SCHOOL YEAR.

AND. WHEREAS, IN VIOLATION OF STATE LAW IN THE 22-23 SCHOOL YEAR, THE COMMISSIONER FAILED TO PROVIDE SCHOOL DISTRICTS A DOCUMENT IN A SIMPLE, ACCESSIBLE FORMAT THAT EXPLAINS THE ACCOUNTABILITY PERFORMANCE MEASURES, METHODS AND PROCEDURES THAT WILL BE APPLIED FOR THE 22-23 SCHOOL YEAR.

AND. WHEREAS, IN VIOLATION OF STATE LAW IN THE 2023 2024 SCHOOL YEAR, THE COMMISSIONER HAS FAILED TO PROVIDE SCHOOL DISTRICTS A DOCUMENT AND A SIMPLE, ACCESSIBLE FORMAT THAT EXPLAINS THE ACCOUNTABILITY PERFORMANCE MEASURES, METHODS AND PROCEDURES THAT WILL BE APPLIED FOR THE 2023, 2024 SCHOOL YEAR.

AND. WHEREAS, THE DISTRICT BELIEVES THE A F ACCOUNTABILITY SYSTEM SHOULD BE ADJUSTED TO RAISE STANDARDS, BUT ONLY WITH THE APPROPRIATE ADVANCE NOTICE.

AND. WHEREAS, THE PURPOSE OF THE ADA F ACCOUNTABILITY SYSTEM IS TO PROVIDE TRANSPARENCY AND CLARITY FOR SCHOOLS, PARENTS AND THE COMMUNITY AT LARGE ABOUT THE PERFORMANCE OF TEXAS PUBLIC SCHOOLS IN RELATION TO STATE EXPECTATIONS.

AND. WHEREAS, CONTRARY TO THE PURPOSE OF TRANSPARENCY REGARDING SCHOOL PERFORMANCE, THE RATINGS INTENDED TO BE ISSUED BY THE COMMISSIONER UNDER THE

2022 2023 SCHOOL YEAR, WILL GIVE THE APPEARANCE THAT SCHOOLS WITH HIGHER LEVELS OF STUDENT ACHIEVEMENT ARE ACTUALLY DECLINING IN PERFORMANCE. AND.

WHEREAS, THE FAILURE OF THE COMMISSIONER TO COMPLY WITH STATE LAW AND PROVIDE AN EXPLANATION OF THE MEASURES, METHODS AND PROCEDURES TO BE USED DURING THE 2022, 2023 SCHOOL YEAR PREVENTED THE DISTRICT FROM APPROPRIATELY ADJUSTING ITS PRACTICES AND ALLOCATION OF RESOURCES IN ACCORDANCE WITH STATE EXPECTATIONS. AND.

WHEREAS, THE RETROACTIVE APPLICATION OF NEW MEASURES, METHODS AND PROCEDURES WITHOUT THE REQUIRED ADVANCE NOTICE REPRESENTS HARM TO THE DISTRICT AND ITS COMMUNITY BECAUSE IT GIVES THE APPEARANCE OF DECLINING SCHOOL PERFORMANCE, WHICH IMPACTS ENROLLMENT PROPERTY VALUES, THE APPLICATION OF POTENTIAL SANCTIONS BY THE COMMISSIONER AND THE EFFECTIVE USE OF RESOURCES.

AND. WHEREAS, SEVERAL TEXAS SCHOOL DISTRICTS HAVE FILED A LAWSUIT SEEKING AN INJUNCTION TO PREVENT THE COMMISSIONER FROM ISSUING NEW RATINGS USING THE RETROACTIVELY YET TO BE I'M SORRY, RETROACTIVELY APPLIED YET TO BE FINALIZED MEASURES, METHODS AND PROCEDURES.

AND. WHEREAS, THE DISTRICT AGREES WITH THE ARGUMENTS LAID OUT IN THE LAWSUIT AND BELIEVES THE INTENTION OF THE COMMISSIONER TO ISSUE RATINGS USING RETROACTIVELY APPLIED YET TO BE FINALIZED MEASURE MEASURES, METHODS AND PROCEDURES TO.

BE IN CONTRAVENTION OF STATE POLICY REGARDING THE ACCOUNTABILITY SYSTEM AND IN VIOLATION OF THE LAW.

NOW, THEREFORE, BE IT RESOLVED THAT ALL THE ABOVE REFERENCED PARAGRAPHS, FINDINGS AND RECITALS ARE INCORPORATED INTO AND MADE PART OF THIS RESOLUTION. THE HAYS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT BOARD OF TRUSTEES DIRECTS THE SUPERINTENDENT TO TAKE THE NECESSARY STEPS TO JOIN THE LITIGATION CHALLENGING OF THE COMMISSIONER'S FAILURE TO PROVIDE TEXAS SCHOOL DISTRICTS ADVANCE NOTICE OF THE MEASURES, METHODS AND PROCEDURES TO BE USED IN THE 2022, 2023 AND 2023, 2024 SCHOOL YEARS PRIOR TO THE START OF EACH OF THOSE SCHOOL YEARS IN VIOLATION OF STATE LAW.

THE HAYS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT BOARD OF TRUSTEES URGES THE COMMISSIONER TO COMPLY WITH STATE LAW AND ISSUE RATINGS FOR THE 2022, 2023 AND 2023, 2024 SCHOOL YEARS UTILIZING THE EXISTING MEASURES, METHODS, AND PROCEDURES OF WHICH SCHOOL DISTRICTS HAD NOTICE IN ACCORDANCE WITH STATE LAW.

BASED ON THAT, I MOVE THAT THE HAYS CISD BOARD OF TRUSTEES ADOPT A RESOLUTION TO JOIN LITIGATION REGARDING THE ADA ACCOUNTABILITY SYSTEM AS PRESENTED SECONDED BY MRS. OROSCO. DISCUSSION.

THANK YOU. SO WHEN WE FIRST HAD THE OPPORTUNITY TO JOIN THE KINGSVILLE ET AL VERSUS MORATH LAWSUIT, I WAS KIND OF ON THE FENCE ABOUT IT BECAUSE IT WASN'T GOING TO HURT OUR OVERALL RATING LIKE IT WILL SOME OTHER DISTRICTS ACROSS THE STATE.

BUT THEN I STARTED THINKING ABOUT THE PRINCIPLE OF THE MATTER AND THE FACT THAT OUR KIDS HAVE WORKED EXTREMELY HARD.

OUR EMPLOYEES HAVE WORKED EXTREMELY HARD.

WE'RE SHOWING GROWTH ACROSS ALMOST EVERY AREA.

AND YET THE RATING THAT WE GET IS GOING TO REFLECT THAT WHEN WE WENT BACKWARDS INSTEAD OF FORWARDS.

AND SO WHEN I, I REALLY REFLECTED UPON THAT AND THE FACT THAT THE COMMISSIONER AT TEA HASN'T NOTIFIED US, WE STILL DON'T KNOW WHAT THE RULES OF THE GAME ARE GOING TO BE AND THE GAME IS ALREADY OVER.

IT'S ALREADY BEEN PLAYED AND WE'VE ALREADY STARTED THIS YEAR.

SO NOT ONLY DOES IT IMPACT LAST YEAR'S RATINGS, IT WILL IMPACT THIS YEAR'S RATINGS.

I FELT COMPELLED TO RECOMMEND THAT WE JOIN THIS SUIT.

AS OF NOW, THERE ARE OVER 50 SCHOOL DISTRICTS ACROSS THE STATE THAT HAVE JOINED.

AND SO THE COST FOR JOINING THIS LAWSUIT IS NEGLIGIBLE.

BUT THIS LAWSUIT WILL SEEK ONE OF TWO OPTIONS ONE FOR THE COMMISSIONER TO ISSUE RATINGS FOR THE 22-23 SCHOOL YEAR BASED ON THE EXISTING SYSTEM, BECAUSE I THINK THAT WILL SHOW GROWTH.

AND IT WOULD BE FAIR BECAUSE RIGHT NOW, IF HE JUST ARBITRARILY PUTS IN THESE NEW RULES, THEN THOSE CAMPUSES AND THOSE DISTRICTS THAT RELY HEAVILY ON THE GROWTH MEASURE FOR DOMAINS TWO AND DOMAINS THREE, THOSE CAMPUSES ARE GOING TO REALLY STRUGGLE.

AND SO ONLY THOSE CAMPUSES AND DISTRICTS THAT ARE EXTREMELY WEALTHY WILL FARE WELL IN THIS NEW SYSTEM.

AND SO BECAUSE OF THAT PRINCIPLE, I AM RECOMMENDING THAT YOU APPROVE THIS TONIGHT.

AND THE OTHER PIECE IS WHEN THEY FILE THE TEMPORARY RESTRAINING ORDER AGAINST THE COMMISSIONER.

IF WE'RE NOT PART OF THE LIST OF PLAINTIFFS, THEN IF THEY OFFER RELIEF, WE MAY NOT BE ON THAT LIST.

AND SO, AS YOU KNOW, I'M ALL ABOUT RAISING THE BAR.

I BELIEVE IN ACCOUNTABILITY.

AND I BELIEVE IN CLOSING GAPS AND I BELIEVE IN ALWAYS BEING TRANSPARENT.

BUT IF OUR LEADER, THE COMMISSIONER, IS NOT OFFERING UP ALL THOSE THINGS IN ADVANCE AND THE SYSTEM IS NOT FAIR, THEN I THINK WE NEED TO GO DOWN THIS ROAD AND PURSUE THIS AVENUE FOR SURE.

IT'S OBVIOUS WHAT IS HAPPENING WHEN WE ARE TOLD WE ARE BEING RATED ON A SYSTEM THAT WE DIDN'T KNOW ABOUT AND WE STILL REALLY DON'T KNOW THE FINE DETAILS ABOUT.

RIGHT. SO IT WAS INTERESTING.

I ATTENDED THIS MEETING ACTUALLY, MR. MCMANUS AND I AND MR. FLORES ATTENDED THIS MEETING AND WE HAD SOME INFORMATION THAT WAS PRESENTED AND IT WAS TALKING ABOUT OUT OF THE 1600 HIGH SCHOOLS IN THE STATE, WE HAVE 1600 HIGH SCHOOLS.

WELL, WITH THE CHANGE IN THE ACCOUNTABILITY SYSTEM, WHERE BEFORE 1100 OF THOSE CAMPUSES WOULD BE ABLE TO GET AN A WHEN THEY WERE RATED BASED ON THAT 60 MEASURE OF CMR. NOW, ONLY 384 CAMPUSES ACROSS THE STATE OF TEXAS WOULD RECEIVE AN A BASED ON THE NEW MEASURE OF 88.

THAT IS A HUGE DIFFERENCE, AND IT IS SHAMEFUL THAT THE STATE OF TEXAS IS TRYING TO DEMONSTRATE OR TRYING TO MAKE IT SEEM LIKE PUBLIC EDUCATION IS NOT WORKING IN THE STATE OF TEXAS.

IT IS.

HOWEVER, WE SEE THERE'S A SHORTAGE OF TEACHERS.

THERE IS A SHORTAGE OF STAFF.

AND WHY? BECAUSE PUBLIC EDUCATION HAS BEEN THE SCAPEGOAT FOR THE STATE OF TEXAS AND IS JUST A POLITICAL PAWN IN THIS STATE.

AND IT IS NOT VALUED THE WAY IT SHOULD BE.

IT'S SHAMEFUL THAT IT DOES SEEM LIKE OUR CHILDREN, OUR STUDENTS ARE NOT PERFORMING, ARE NOT GROWING, OUR TEACHERS ARE NOT WORKING.

OUR ADMINISTRATORS ARE NOT DOING WHAT THEY NEED TO DO TO GET US TO THIS HIGHER RATING WHEN IN FACT THEY ARE.

AND THAT IS A SURE WAY TO BURN OUT MORE EDUCATORS IN THE SYSTEM.

AND IT IS SHAMEFUL THAT WE ARE FAILING OUR 5.5 MILLION CHILDREN IN THE STATE OF TEXAS.

SO I AM.

READY TO SIGN OFF ON THIS RESOLUTION.

IT IS SHAMEFUL THAT WE HAVE TO DO THIS AND CALL ATTENTION TO COMMISSIONER MORATH AND SAY ENOUGH IS ENOUGH.

SO FOR THIS REGION, THAT WOULD BE SOMEBODY IF THEY'RE MAKING BETWEEN 60% OF THE AMI AND 80%, THEY'RE EARNING ABOUT 73,090 $7,000. THIS IS A VERY HIGH AMI REGION, WHICH IS WHY PEOPLE ARE STRUGGLING TO AFFORD HOUSING.

THE FOUNDATION'S PURPOSE.

LIKE I SAID, THAT WAS FOR THE GENERAL POPULATION.

BUT IN NOVEMBER OF 22, THEY ADOPTED A RESOLUTION THAT AUTHORIZED US TO START TALKING TO SCHOOL DISTRICTS.

SPECIFICALLY, WHEN YOU THINK ABOUT WORKFORCE HOUSING, THE SAME KIND OF CAST OF CHARACTERS ALWAYS COMES UP.

IT'S TEACHERS, NURSES, FIRST RESPONDERS.

AND SO THEY FIGURED IF WE GO TO THE LARGEST EMPLOYER OF TEACHERS, THAT MAKES SENSE.

AND IF A PROPERTY COMES OFF THE TAX ROLLS DUE TO THE PROPERTY TAX EXEMPTION FOR WORKFORCE HOUSING, THE SCHOOL DISTRICT IN THEORY IS THE MOST IMPACTED BECAUSE YOU GENERALLY HAVE THE HIGHEST TAX MILL RATE.

SO TALK TO THE PEOPLE WHO EMPLOY THE MOST TEACHERS AND ALSO COULD POTENTIALLY BE THE MOST IMPACTED.

WHAT THIS FOUNDATION OFFERS.

IN ADDITION TO PROVIDING PRIORITY ACCESS FOR THE WORKFORCE THAT THE DISTRICT EMPLOYEES, THEY ALSO WILL CONTRIBUTE AN INITIAL UPFRONT CONTRIBUTION TO THE TEXAS EDUCATOR HOUSING AFFORDABILITY FUND IN THE AMOUNT OF $250,000.

AND THEN THERE'S ONGOING PAYMENTS EACH YEAR OF AT LEAST $50,000 TO MAKE SURE THAT YOU NEVER RUN OUT OF MONEY AND THAT YOU ALWAYS HAVE SOMETHING THERE TO PROVIDE ESSENTIALLY AN ADDITIONAL SUBSIDY FOR THE EMPLOYEES OF THE DISTRICT.

AND I ALWAYS SAY EMPLOYEES.

IT'S NOT NECESSARILY JUST TEACHERS.

IT'S, YOU KNOW, SOMEBODY MAKING 30% OF AMI THAT'S GOING TO BE A BUS DRIVER OR CAFETERIA STAFF.

YOU KNOW YOUR PERSONNEL BETTER THAN I DO.

BUT IT'S THAT FULL RANGE OF DISTRICT EMPLOYEES THAT THEY WANT TO TRY TO HELP SUPPORT.

SO LIKE I MENTIONED, THE AFFORDABILITY FUND IS SET UP.

IT'S WHAT WE'RE TRYING TO DO IS CREATE A TURNKEY SOLUTION SO YOU DON'T HAVE TO BE A LANDLORD, YOU DON'T HAVE TO RUN A LEASING OFFICE AND YOU DON'T HAVE TO MAKE PAYMENTS ON BEHALF OF YOUR EMPLOYEES IN LARGE PART ALSO BECAUSE IF THEY PAY THAT THAT SUBSIDY ON BEHALF OF THE TEACHER, IF IT DOESN'T COME FROM THEIR EMPLOYER, IT'S NOT TAXED AS TAXABLE INCOME.

SO IF IT COMES FROM YOU, IT WOULD BE TAXED.

BUT IT WOULD BE BUY DOWN RENT, POTENTIALLY COVER SECURITY DEPOSITS, PET DEPOSITS, MOVING COSTS.

AND THEN FOR PEOPLE WHO ARE LIVING IN THESE APARTMENTS, IF THEY ARE ATTEMPTING TO PURCHASE THEIR FIRST OR THEIR NEXT HOME, MAYBE DOWN PAYMENT ASSISTANCE FOR THEM TO HELP THEM ACTUALLY MOVE OUT OF THAT PHASE OF THEIR LIFE AND PURCHASE THEIR HOME HERE IN THE DISTRICT.

LIKE I MENTIONED, THEY ALSO PROVIDE PRIORITY ACCESS.

RIGHT. AND SO WE TRY TO CUT DOWN ON COMMUTE TIME FOR OUR EMPLOYEES AND WE TRY TO ACCOMMODATE THEM IN CLASS A SPACES, YOU KNOW, THESE ARE JUST EXAMPLES OF THE [INAUDIBLE] THAT'S ACTUALLY OVER HERE.

SO YOU MAY GET ADDITIONAL SAVINGS BEYOND THAT 30% RENT CAP.

THE I GUESS THE ASK ON BEHALF OF THE DISTRICT IS IF YOU FIND A PROJECT LIKE THE CHLOE, FOR EXAMPLE, THEN YOU WOULD SAY, YES, WE DO APPROVE OF YOU GUYS GOING AND TRYING TO ACQUIRE THAT BECAUSE WE DON'T OWN IT RIGHT NOW.

OKAY. SO LET ME ASK YOU, HOW DO YOU DETERMINE THE AMOUNT OF UNITS I KNOW YOU SAID YOU WOULD DO LIKE KIND OF LIKE A SURVEY OR SOMETHING, BUT IS THERE A GUARANTEED MINIMUM SLOTS THAT WE WOULD HAVE FOR OUR PEOPLE? RIGHT. THAT'S A GREAT QUESTION.

IF WE HAVE AN APARTMENT COMPLEX THAT HAS 300 UNITS AVAILABLE, MAYBE WE COULD OFFER 25 TO 50 UNITS TO YOUR EMPLOYEES.

AND THE REASON WHY WE KEEP IT AROUND THAT NUMBER IS SOMEWHERE BETWEEN 25 AND 50 IS BECAUSE WE HAVE TO BE MINDFUL OF THE AFFORDABILITY FUND AND HOW MUCH MONEY IS ACTUALLY IN THERE THAT WE COULD USE TO PAY DOWN RENT.

AND SO GIVE YOU A ROUND ROCK ISD FOR AN EXAMPLE.

THERE'S FOUR APARTMENT COMPLEX THERE WITH 100 UNITS AVAILABLE TO THEIR EMPLOYEES RIGHT NOW, EACH EMPLOYEE WHO TAKES ADVANTAGE OF THE PROGRAM AND MOVES INTO A UNIT IS RECEIVING IS RECEIVING $250 A MONTH REDUCTION OF THEIR RENT.

THAT $250 IS COMING OUT OF THE AFFORDABILITY FUND TO PAY THE APARTMENT COMPLEXES ON THE EMPLOYEES BEHALF.

THE RESTROOM OFF THE ICE WILL NOW BE A PART OF THE COSMETOLOGY LAB.

WE'VE BEEN ABLE TO CREATE A 1200 SQUARE FOOT LAB SPACE, CLASSROOM SPACE, WHICH WILL BE SIGNIFICANTLY BIGGER THAN ANY SPACE THEY HAVE RIGHT NOW TO UTILIZE, EXCEPT FOR THE ART ROOM THAT THEY'RE THEY'RE BORROWING.

WE HAVE ENOUGH ROOM TO BE ABLE TO PUT BACK A STORAGE ROOM THAT WE HAD TO TAKE OUT THAT CURRENTLY RESIDES RIGHT HERE.

WE TOOK IT OUT BECAUSE THAT WOULD ACTUALLY ALLOW THE COSMETOLOGY SUITE TO BE ONE CONTIGUOUS SPACE RATHER THAN FEELING LIKE IT'S DIVIDED UP.

THE REQUEST THAT WAS MADE WAS FOR SEVEN ADDITIONAL SALON STATIONS, THREE ADDITIONAL SHAMPOO STATIONS.

WE'RE ACTUALLY ABLE TO GET THEM EIGHT ADDITIONAL SALON STATIONS, SO ONE MORE THAN THEY ASKED FOR AND WE'RE ABLE TO GET THEM.

FOUR. SO SHAMPOO STATIONS, SO ONE MORE THAN THEY ASKED FOR.

THEY CURRENTLY HAVE TWO NAIL STATIONS.

WE ACTUALLY ABLE TO GET THEM TWO MORE.

SO WE'VE DOUBLED THE NUMBER OF NAIL STATIONS THEY HAVE.

WE STILL HAVE A LOT OF CASEWORK SPACE FOR STORAGE ALONG THE WALLS.

AND THEN THESE DASHED BOXES HERE ARE SOME EXISTING FURNITURE PIECES THAT THEY HAVE IN THE SPACE RIGHT NOW.

THEY'RE CURRENTLY OUT IN THE MIDDLE OF THE SPACE, SO WE PUT THEM BACK OUT IN THE MIDDLE OF SPACE LIKE THEY HAVE IT RIGHT NOW.

SO I THINK COSMETOLOGY IS VERY WELL TAKEN CARE OF.

WE'RE ABOVE AND BEYOND WHAT THEY'VE ASKED FOR IN THE CULINARY SPACE.

THERE'S ACTUALLY A LITTLE BIT OF EXTRA ROOM HERE TO CREATE A SMALL STORAGE CLOSET FOR SOME CLEANING, SOME CLEANING SUPPLIES.

WE HAVE SOME REQUESTS FOR SOME STORAGE ON THE BACK WALL BACK HERE FOR THE OUTDOOR STORAGE.

WE'VE BEEN TALKING THROUGH HOW TO MAKE THE STORAGE IN THE MULTIPURPOSE INDOOR SPACE THE MOST FUNCTIONAL.

SO THEY HAVE A VARIETY OF THINGS THAT THEY WANT TO STORE IN THERE.

THEY HAVE THESE CARTS THAT HAVE TARPS ON THEM.

AND THAT DOOR WILL BE SIZED TO ALLOW THE VOLLEYBALL CART TO GET IN AND OUT.

THIS HAS ACTUALLY CHANGED SINCE THEN.

SO WE HAD DIRECTION AT ONE POINT TO ONLY HAVE TWO BASKETBALL GOALS IN THE MULTI-PURPOSE INDOOR SPACE.

THAT HAS SINCE CHANGED BACK TO HAVING THE FOUR SIDE GOALS AS WELL.

SO THERE WILL BE SIX GOALS.

BUT WHAT HAS CHANGED IS THAT WE ARE NOT GOING TO DO THE STRIPING ON THE FLOOR FOR THE SIDE COURTS FOR BASKETBALL.

WE WILL HAVE THE TWO PRACTICE COURTS FOR VOLLEYBALL, WHICH ACTUALLY COULD SERVE AS COMPETITION COURTS IF YOU NEEDED TO, BECAUSE THEY DON'T TAKE UP A LOT OF SPACE.

WE'VE GOT A WALL OF WINDOWS I'M SORRY, A WALL OF MIRRORS ON ONE SIDE.

AND THERE'S BEEN A LOT OF DISCUSSION ABOUT HOW TO PROTECT THOSE MIRRORS WHEN THE SPACE IS BEING USED FOR OTHER THINGS, PARTICULARLY THINGS THAT INVOLVE THROWING BALLS AROUND.
